Terms & Conditions

1. General

These Terms and Conditions apply to all sales and supply of goods by New World Timber Limited ("the Company", "we", "us") to the buyer ("you", "the Customer"). By placing an order with us, you agree to be bound by these terms.

The Company is registered in England and Wales. Registered office: Unit E, Hill Barton Business Park, Clyst St Mary, Exeter, EX5 1SB.

2. Trade customers only

We supply to trade customers only. By placing an order, you confirm that you are purchasing in the course of a business, trade, or profession, and that the Consumer Rights Act 2015 does not apply to your purchase.

3. Orders and acceptance

All orders are subject to acceptance by the Company. An order is not binding until confirmed by us in writing (including email). We reserve the right to decline any order without giving a reason.

Prices quoted are valid for the period stated in the quotation, or where no period is stated, for 14 days from the date of the quotation. Timber and panel product prices are subject to market movement; we reserve the right to revise prices prior to order confirmation.

4. Prices and payment

All prices are exclusive of VAT unless otherwise stated. VAT will be charged at the rate applicable at the time of invoice.

Payment is due as specified in our quotation or invoice. For account customers, payment terms are as agreed. For non-account customers, payment is due prior to or on collection.

We reserve the right to charge interest on overdue amounts at 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

5. Delivery and collection

Risk in the goods passes to you on delivery or collection, whichever is earlier. Where we arrange delivery, it is to the kerbside or nearest accessible point; we do not accept responsibility for site access issues.

Trade counter collections are by pre-booked appointment only. Mon–Fri, 8:15am–12pm. Please call ahead to arrange. We cannot guarantee availability for unbooked collections.

Any delivery timescales quoted are estimates only. We shall not be liable for delays beyond our reasonable control.

6. Title and risk

Title in the goods does not pass to you until payment in full has been received. Until title passes, you must store the goods separately and clearly identified as our property.

We reserve the right to recover goods where payment has not been received, and to enter your premises (if necessary) for that purpose.

7. Inspection and claims

You must inspect all goods on delivery or collection and notify us of any visible defect, shortage, or damage within 24 hours. Failure to do so will be taken as acceptance of the goods in satisfactory condition.

Any claim for defect or non-conformity of goods must be made in writing within 7 days of delivery. We may require the return of samples for inspection before any credit is considered.

8. Specification and natural variation

Timber and panel products are natural materials subject to variation in colour, grain, and character. Such variation is not a defect. Images shown on our website are for illustrative purposes only.

Section sizes, lengths, and moisture content are subject to manufacturing tolerances in accordance with relevant British and European standards.

9. Limitation of liability

Our liability to you shall not exceed the invoice value of the goods in question. We shall not be liable for indirect or consequential losses, loss of profit, or loss of business opportunity, whether arising in contract, tort, or otherwise.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10. Returns

Goods will not be accepted for return without prior written agreement. Where a return is agreed, goods must be in their original condition, unprocessed, and suitably packaged. A handling charge may apply.

11. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
